Because institutions can lose practical control of machine governance through contracts. A public institution cannot outsource constitutional accountability. High-impact procurement should preserve audit access, model lineage, purpose boundaries, incident reporting, appeal integration and restoration obligations.
Vendor contracts determine data access, subprocessors, update rights, retention, auditability, incident disclosure and termination. Constitutional constraints that are absent from procurement may be technically impossible to add later without migration.
The UK AI Playbook addresses buying AI, human control, data protection and assurance; NIST AI RMF treats governance as a lifecycle function. Concresca’s detailed procurement controls remain proposals built on those governance directions.
