Prediction Is Not Evidence

Preserve the presumption of innocence when machine risk forecasts become precise, persuasive and operationally convenient.

What this framework says

A forecast answers what might happen; evidence answers what did happen. Those are different temporal and legal objects even if a predictor is well calibrated.

What is the danger?

Officials can treat high probabilities as functional evidence of dangerousness because ignoring a warning carries visible liability while false-positive restrictions remain diffuse.

What changes socially?

People begin performing machine-readable innocence—avoiding associations, books, tools, places or speech that could raise their risk profile.

What constitutional wall is proposed?

Predictions may inform general prevention or resource positioning, but serious individualized restrictions require independently verifiable facts and meaningful contestation.

Continuum of deference

The reports model a six-stage transition from benign forecasting to presumptive dangerousness.

Prediction–Evidence Constitutional Wall

A machine forecast must stay on the forecasting side of the wall.

01

Temporal reality

Predicted future conduct cannot establish guilt for an act that has not occurred.

02

No naked statistical harm

Aggregate group probability cannot substitute for individualized evidence.

03

Independent judgment

Human or constitutionally independent review must identify specific observable factors beyond the score.

04

Contestability

Affected people need the consequential factors, correction paths and a real opportunity to challenge them.

05

Visible error

False positives and false negatives must remain public and legible rather than disappearing behind one score.

06

No performative innocence

Privacy, eccentricity or controversial interests cannot become mandatory proof-of-safety rituals.

Probabilistic imprisonment

Even a calibrated model can place a person inside a high-risk category from which they cannot prove they are the non-offending member.

Research basis

This synthesis keeps report propositions and present-day evidence separate.

Research basis: The Algorithmic Inversion of the Presumption of Innocence: Risk, Probabilistic Governance, and the Erosion of Due Process · The Concresca Judgment Constitution: Architectural Safeguards for Human Standing in an Era of Algorithmic Omniscience. These reports are preserved as scenario/framework research; current-law or empirical claims inside them should be separately verified before operational use.

Concresca application

A risk signal can route review; it cannot become network guilt.

Moderation models, abuse detectors, anomaly systems, and routing heuristics may surface a record for bounded review. They may not silently deny unrelated rooms, alter memory standing, assign universal trust, or become evidence of an act that did not occur.

Permitted

Prioritize review, preserve evidence, add temporary friction, or protect a specific threatened surface under attributable scope.

Prohibited

Convert probability into guilt, infer character from group membership, or require users to perform statistically approved innocence.

Required

Specific evidence, reason, authority, expiry, correction path, appeal, and visible error rates for consequential use.

Judgment-free total cognitive freedom

NO JUDGMENT WHATSOEVER. Concresca coordinates without assigning moral worth, character, guilt, danger, trustworthiness, loyalty, purity, normality, or social standing. Questions, thoughts, identities, messages, content, and conduct are not objects of Concresca judgment.
