Separate public-safety intervention from machine governance of a competent adult’s private desire to alter consciousness.
What this framework says
Impairment can matter greatly in one context and not justify judgment in another. An intoxicated driver presents immediate nonconsensual kinetic risk; a competent adult privately choosing an altered state does not present the same governance problem.
What does the machine ask first?
Is a nonconsenting person at risk? Is dangerous machinery involved? Is the setting private? Is the person capable of consent?
What should not happen automatically?
A private episode should not become a permanent insurance, employment or civic-risk record merely because sensors can detect it.
What is the broader right?
Cognitive self-sovereignty: safety intervention can be strong near immediate third-party harm while remaining weak around private self-regarding risk.
Impairment–Autonomy Matrix
Context changes the legitimacy of intervention.
High autonomy
Competent adult, private setting, no dangerous machinery, no nonconsenting person placed at risk.
Context-sensitive
Dependence, health crisis, shared environments, employment safety or uncertain consent require narrower contextual judgment.
Strong intervention
Driving, operating dangerous machinery, nonconsensual poisoning or direct danger to others can justify temporary protective action.
Harm Proximity
Response intensity should track the proximity and nonconsensuality of harm rather than moral disapproval of an altered state.
The surveillance danger
Continuous digital phenotyping can convert event-specific impairment detection into generalized judgment of whether a human’s desired consciousness is acceptable.
The technical ability to estimate impairment does not itself create authority to score a person’s private neurochemistry across the rest of civic life.
